A consultation draft of the Community Titles Regulation 2020, to accompany the Community Titles Act 2018, was available for public comment between 9 November and 9 December.
Community titles are a new form of land title, which are expected to facilitate more complex or mixed-use subdivision and development within a shared ownership environment.
This new title is different to current strata titles which allow only one scheme to be created on a single parcel of freehold land. The land can be further subdivided by changes to lot boundaries and common property, but this does not include subdividing a lot to create another scheme.
Landgate and the Department of Planning, Lands and Heritage are currently reviewing feedback received during the public consultation period. Delivery of the final regulations to Parliament and commencement of the new Community Titles Act 2018 is anticipated by mid-2021.
